Scope and Contents note

Overview

The Charles C. Killingsworth papers provide an invaluable source of material to the researcher interested in the development of American labor law, and its application to the collective bargaining process. With the exception of some material from World War I, the collection is composed of labor materials. Killingsworth served as a member of several federal agencies, as a consultant to state and private organizations and as an arbitrator and permanent umpire for many large corporations.

The papers span the years from 1918, when the National War Labor Board of World War I was created to resolve issues raised by a fledgling labor movement, to 1968, when labor unions had become powerful fixtures in virtually every major industrial sector of our economy. Arbitration decisions comprise the bulk of the collection, though these are generally accompanied by background information on the grievance, company and unions exhibits, and correspondence. In those instances where the dispute captured public attention, the material is also accompanied by newspaper articles and editorials. These supplementary materials are of special interest because they reveal the social and political climate in which the disputes took place.

The collection also contains material from various federal labor agencies, such as the Wage Stabilization Board and the National War Labor Boards of World War's I and II, as well as various state agencies. In addition, there is a large assortment of publications, ranging from trade journals to U.S. Government reports.

Collection Inventory

Series I. Labor Dispute 

Scope and Contents note

This category has been further subdivided into three types of disputes: industry wide, corporate-level and plant-level. Boxes 1 through 3 contain documents related to industry-wide disputes. These can be defined as labor disputes in which a majority of the firms within a particular industry are engaged in a dispute with a national union which has organized that industry's workers. Two industries are represented in the collection - coal and steel. Of particular significance are the steel disputes of 1952, when President Truman seized the steel industry to prevent a strike; and 1959, when both the companies and the Steelworkers union launched massive advertising campaigns to plead their causes before the nation. All of the materials in this section have been arranged chronologically.

Box 3 to Box 7, Folder 9, contain arbitration decisions and related materials pertaining to corporate-level disputes. These types of disputes encompassed entire corporations, including all plants. As an arbitrator, Dr. Killingsworth heard many of the disputes in this category. They are arranged alphabetically, by the name of the company.

Most of the Labor Disputes material is composed of arbitration cases involving plant-level grievances. These are also arranged alphabetically by name of company and then by name of plant. Box 7, Folder 10 to Box 23, Folder 36, contains these materials. (The researcher should note that many of the individual arbitration proceedings are incomplete. Some lack the decision, while others are missing exhibits or awards). Dr. Killingsworth, as umpire or arbitrator for the Bethlehem Steel, U.S. Rubber, Ford Motor, Goodyear and Youngstown Sheet and Tube Companies, heard many of the grievances contained in this portion of the collection.

Scope and Contents note

This category, extending from Box 23, Folder 37 to Box 24, Folder 9 contains reports, memos, articles, and correspondence from the period 1951-1953. The Wage Stabilization Board, of which Dr. Killingsworth became Chairman, was created in 1951 to promote industrial peace so that vital production would not be hampered during the Korean War. Researchers may be particularly interested in the several articles describing wage controls which this section contains, authored by such notables as Nathan Feinsinger and Archibald Cox. Also of special interest are the excerpts from transcripts at the House investigations of the Wage Stabilization Board, in which allegations were made that the Board was influenced by Communists.

This category, extending from Folders 17-31 of Box 25, contains cases heard by the Civil Service Commission of Michigan, Connecticut, Illinois, New Jersey, and New York. Included are four advisory reports prepared for the Michigan Civil Service Commission in 1958 by Dr. Killingsworth and Melvin Segal.

The next three categories: Connecticut Board of Labor Relations, Ontario Labor Relations Board, and Wisconsin Employment Relations Board extend from Box 25, Folder 32 to Box 27, Folder 13. These agencies were designed to hear unfair labor practice cases and hold union certification elections.
